Suspects Rights in Pennsylvania: What NOT to Do
This article discusses a suspects legal rights during a police investigation or arrest and offers suggestions on some common errors you should avoid. Don't Run from Cops
Running will greatly increase, if not guarantee, your chances of being arrested.
Fleeing from the police is a separate crime that you will be charged with and will complicate your case and your time in prison if convicted. If a police officer is injured in the chase or property is damaged you will also be responsible for those issues.
It is also unlikely that fleeing or resisting arrest will be successful.
Don't Touch a Police Officer
This mistake happens often and will quickly turn a misdemeanor arrest into a felony arrest.
Touching, struggling or fighting with the police will lead to much more serious charges than what was originally investigated.
Don't React to a Search
Do not focus on areas you want the police to avoid.
Do not respond to questions about who the owner of an item is.
Don't Verbally Abuse the Cop(s) Who Arrest You
Police officers possess a great deal of power with the District Attorney's Office and will have a say on if certain charges are dropped or a plea in the defendant's favor is offered. They can also encourage a DA to seek the most severe penalties.
Nothing is gained by yelling at the police. The police may not remember if you were polite; however, they will certainly recall if you were nasty during the arrest.
Don't Let the Police Enter Your Home Without a Warrant
Understand that the police do not need a warrant to search your house if you invite them into your home. Do not allow the police into your home without a warrant.
If the police want to talk to you talk to without a warrant speak with them though a screen door or through a slightly opened door.
Do not step outside to talk to the police because they can arrest you without a warrant.
If you are arrested outside your home do not allow the police to escort you into your home to get personal belonging or for any other reason. Once the police have entered your home under these circumstances, they can then legally search it without a warrant. Go to jail without a shirt or your shoes if you have to.
Don't Lie to the Police or Give Then False Identification
Fleeing to the police is a crime and can get you in greater trouble them the offense you were originally questioned on.
