Four Juvenile Clients Given Consent Decrees

Luzerne County Juvenile Defense Attorney David Lampman resolves four juvenile cases with consent decrees. 237 Pa. Code Rule 370 covers consent decrees; Pennsylvania courts defined a consent decree as "a device for placing an allegedly delinquent juvenile under supervision of the juvenile probation office prior to, and as an alternative to, adjudication, thus avoiding potential stigma attached to an adjudication of delinquency." Commonwealth v. Wexler, 431 A.2d 877 (Pa. 1981).

The effect of this is that the juveniles will remain home with their family while they serve a term of probation. Once they successfully complete the terms of the consent decree the charges will be dropped. To date, no juvenile represented by Attorney Lampman has been sent to a Juvenile Placement (Detention) Facility.
